This paper tries to synthesize the a priori foundations of Kant’s autonomy principle, deciphering its sense and epistemic value, from the Critique of Practical Reason to the Foundations of Metaphysics of Customs.

Neste texto pretende-se sintetizar os fundamentos a priori do principio da autonomia de Kant, decifrando o seu sentido e valor gnoseologicos desde a Critica da Razao Pratica ate aos Fundamentos da Metafisica dos Costumes.

A aprovação pela Assembleia da República de uma lei sobre declarações antecipadas de vontade justifica que se comentem os textos que lhe serviram de base, apresentados pelo Partido Socialista, Partido Social-Democrata, Partido CDS-PP e Bloco de Esquerda, na perspetiva da sua formulaçāo jurídica e de algumas dificuldades éticas encontradas na sua aplicabilidade médica. Da análise das propostas deduzem-se os requisitos jurídicos, éticos e de assistência na doença necessários para que se escreva um bom "testamento vital" que não levante dificuldades insuperáveis (...) quando o médico tiver de ter em conta estas declarações antecipadas de vontade face a um doente inconsciente que não pode manifestar a sua vontade actual. Analisa-se o conceito de autonomia diacrónica, como uma autonomia que se exerce hoje para ser eficaz amanhã e critica-se esta opçao legislativa, Por fim sugere-se que a melhor soluçao para a insegurança da pessoa, face á qualidade dos cuidados que lhe serão prestados na fase final da sua vida, não é o testamento vital mas a designação de um Procurador de saúde. The approval by the Portuguese National Parliament of a law concerning the anticipated declaration of will deserves a commentary on the texts upon which the Socialist, Social-Democrat, Centrist, and Leftist parties based their respective juridical formulations. The commentary will include a consideration of the ethical difficulties found in their eventual medical application. From an analysis of the proposals, one can deduce the juridical, ethical, and care requirements necessary to write a living will that does not raise insuperable difficulties when the physician has to consider these anticipated declarations of will in regard to a patient who is unconscious and unable to express his will as he currently understands it. The concept of diachronic autonomy, i.e., an autonomy that is exercised today such that it might be efficacious tomorrow, receives a critical analysis. Finally, the author suggests that the best solution for a person's insecurity in the face of the quality of care that will be administered to him in the final phase of his life is not a living will but the designation of an attorney-in-fact who will look after his health issues. Resumo Ensaio expositivo e interpretativo das perguntas sobre a natureza humana e das respostas que o pensamento moderno, em Merlin Donald e outros, vai dando. A perspetiva fisicalista, neurobiológica, é analisada a partir de Joseph LeDoux, e outros, comentando as suas teses principais. É dada ênfase particular à evolução das capacidades da mente humana na transição da cultura mimética para a cultura oral, a criação mítica e o advento da escrita e das outras formas de cultura exterior simbólica. Na crítica (...) ao monismo fisicalista é discutido o que se pode entender por qualia e de que modo este entendimento justifica a aceitação de um “hiato explicativo” como o pensam Urbano Sidoncha e outros autores. É abordada a relação entre Pensamento e Linguagem a partir de Lev Vygotsky. Considerando a ética como um qualia procura-se fixar, empiricamente, a diferença entre ética e eticidade como contraponto à diferença entre autoconsciência e consciência cognitiva. Como proposta final é apresentada uma pergunta radical e oferecida uma temerária resposta sobre o possível conhecimento total da natureza humana. The physicalist, neurobiological perspective is analysed as from Joseph LeDoux et al., by commenting on his main theses. Particular emphasis is given to the evolution of the human mind’s capacities in the transition from the mimetic culture to the oral culture, the mythical creation and the advent of writing and the other forms of external symbolic culture. In the critique of the physicalist monism, one discusses what can be understood by qualia and how this understanding justifies the acceptance of an ‘explanatory hiatus’ such as Urbano Sidoncha and other authors think. The relationship between Thought and Language, as from Lev Vygotsky, is addressed. Considering ethics as a qualia, one tries to establish, in an empirical way, the difference between ethics and ethicity in contrast to the difference between self-consciousness and cognitive consciousness. Weisberg and Muldoon’s epistemic landscape model (ELM) has been one of the most significant contributions to the use of agent-based models in philosophy. The model provides an innovative approach to establishing the optimal distribution of cognitive labor in scientific communities, using an epistemic landscape. In the paper, we provide a critical examination of ELM. First, we show that the computing mechanism for ELM is correct insofar as we are able to replicate the results using another programming language. Second, we show (...) that small changes in the rules that determine the behavior of individual agents can lead to important changes in simulation results. Accordingly, we claim that ELM results are robust with respect to the computing mechanism, but not necessarily across parameter space. We conclude by reflecting on the possible lessons to be gained from ELM as a class of simulations or cluster of models. (shrink)

Background: Over the last several decades, scientists and social groups have frequently raised concerns about politicization or political interference in regulatory science. Public actors (environmentalists and industry advocates, politically aligned public figures, scientists and political commentators, in the United States as well as in other countries) across major political-regulatory controversies have expressed concerns about the inappropriate politicization of science. Although we share concerns about the politicization of science, they are frequently framed in terms of an ideal of value-free science, according (...) to which political and economic values have no legitimate role to play in science. For several decades, work in philosophy of science has identified serious conceptual and practical problems with the value-free ideal. -/- Objectives: Our objectives are to discuss the literature regarding the conceptual and practical problems with the value-free ideal and offer a constructive alternative to the value-free ideal. -/- Discussion: We first discuss the prevalence of the value-free ideal in regulatory science, then argue that this ideal is self-undermining and has been exploited to delay protective regulation. To offer a constructive alternative, we analyze the relationship between the goals of regulatory science and the standards of good scientific activity. This analysis raises questions about the relationship between methodological and practical standards for good science, tensions among various important social goods, and tensions among various social interests. We argue that the aims of regulatory science help to legitimize value-laden choices regarding research methods and study designs. Finally, we discuss how public deliberation, adaptive management, and community-based participatory research can be used to improve the legitimacy of scientists as representatives of the general public on issues of environmental knowledge. -/- Conclusions: Reflecting on the aims of regulatory science—such as protecting human health and the environment, informing democratic deliberation, and promoting the capacities of environmental justice and Indigenous communities—can clarify when values have legitimate roles in regulatory science. Philosophers of science have argued that epistemic diversity is an asset for the production of scientific knowledge, guarding against the effects of biases, among other advantages. The growing privatization of scientific research, on the contrary, has raised important concerns for philosophers of science, especially with respect to the growing sources of biases in research that it seems to promote. Recently, Holman and Bruner ( 2017 ) have shown, using a modified version of Zollman ( 2010 ) social network model, that (...) an industrial selection bias can emerge in a scientific community, without corrupting any individual scientist, if the community is epistemically diverse. In this paper, we examine the strength of industrial selection using a reinforcement learning model, which simulates the process of industrial decision-making when allocating funding to scientific projects. Contrary to Holman and Bruner’s model, in which the probability of success of the agents when performing an action is given a priori, in our model the industry learns about the success rate of individual scientists and updates the probability of success on each round. The results of our simulations show that even without previous knowledge of the probability of success of an individual scientist, the industry is still able to disrupt scientific consensus. In fact, the more epistemically diverse the scientific community, the easier it is for the industry to move scientific consensus to the opposite conclusion. Interestingly, our model also shows that having a random funding agent seems to effectively counteract industrial selection bias. Accordingly, we consider the random allocation of funding for research projects as a strategy to counteract industrial selection bias, avoiding commercial exploitation of epistemically diverse communities. Numerous jurisdictions have recently raised the age of retirement or plan to do so. Pressure to extend people's working lives is due to population aging, which makes it harder to fund retirement through existing methods. Raising the retirement age can improve the ‘dependency ratio’ by increasing the fraction of the population that works (and pays taxes) relative to the fraction retired. This article gives sustained attention to connecting the case for retirement with one view about wellbeing, according to which old (...) age is subject to distinctive goods. The importance of being able to access these goods in old age favours an eventual exit from labour market participation that retirement provisions enable. This view is stronger than one that treats retirement as merely a safety net to enable people to stop work only when advanced aging makes it unreasonably burdensome. At the same time, the view likely does not justify status quo retirement ages, meaning that some increase to the retirement age might be defensible. The article also seeks to illuminate ways in which different aspects of population aging – in particular the distinction between dependency ratios and inequalities in longevity – bear differently on the wider debate about justice and retirement. There’s the question of what there is, and then there’s the question of what ultimately exists. Many contend that, once we have this distinction clearly in mind, we can see that there is no sensible debate to be had about whether there are such things as properties or tables or numbers, and that the only ontological question worth debating is whether such things are ultimate (in one or another sense). I argue that this is a mistake. Taking debates about ordinary (...) objects as a case study, I show that the arguments that animate these debates bear directly on the question of which objects there are and cannot plausibly be recast as arguments about what’s ultimate. I then address the objection that, because they are easy answerable, questions about what there is cannot be a proper subject of ontological debate. (shrink)

It is common to hear talk of the aim of belief and to find philosophers appealing to that aim for numerous explanatory purposes. What belief 's aim explains depends, of course, on what that aim is. Many hold that it is somehow related to truth, but there are various ways in which one might specify belief 's aim using the notion of truth. In this article, by considering whether they can account for belief 's standard of correctness and the epistemic (...) norms governing belief, I argue against certain prominent specifications of belief 's aim given in terms of truth, and advance a neglected alternative. Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

The purpose of this text is to examine the nodal points of the interpretation of Bergson presented in “Bergson: Intuição e discurso filosófico”, by Franklin Leopoldo e Silva, in order to make explicit the originality of his circumscription of the problem of language in this philosophy that claims to be intuitive. We argue that the notions of limit and tension are mobilized by the author to demonstrate the inseparable relationship between the critique of discursivity and intuitive access to the absolute (...) that is duration. Numa parte inicial são sucessivamente abordados aspectos da filosofia da natureza e da ontologia da sensibilidade, conducentes à autonomia, ao valor intrínseco e à plenitude do real. Em seguida, considera-se a existência humana do ponto de vista concreto na diversidade de relações que (...) estabelece com o mundo natural. Finalmente, são analisados os principios da ética feuerbachiana da natureza, que conjuga a ética objectiva - do valor intrínseco e dos direitos de todos os seres, incluindo os animais - e a ética subjectiva, no apelo a uma atitude de responsabilidade e a uma contenção do agir por parte do ser humano. /// The present article wishes to show to what degree the thought of Ludwig Feuerbach (1804-1872) anticipates the general tendency in contemporary philosophy to overcome anthropocentrism and to place at the very foundation of reality the original correlation binding humankind with nature. In the initial part, aspects of the philosophy of nature and the ontology of affections (or feeling), leading to the notions of the autonomous, intrinsic, and fullness of the real are treated. In a second moment, human existence is considered in regard to the diversity of its relations with the natural world. Finally, the principles of Feuerbachian ethics of nature are dealt with. It will be seen that it conjugates the objective ethics of intrinsic value and the rights of all beings, including animals, with a subjective ethics with its call to responsibility and restraint on the part of human beings. Physicalism is the thesis that everything is physical, or as contemporary philosophers sometimes put it, that everything supervenes on, or is necessitated by, the physical. The thesis is usually intended as a metaphysical thesis, parallel to the thesis attributed to the ancient Greek philosopher Thales, that everything is water, or the idealism of the 18th Century philosopher Berkeley, that everything is mental. The general idea is that the nature of the actual world (i.e. the universe and everything in it) conforms (...) to a certain condition, the condition of being physical. Of course, physicalists don't deny that the world might contain many items that at first glance don't seem physical — items of a biological, or psychological, or moral, or social nature. But they insist nevertheless that at the end of the day such items are either physical or supervene on the physical. (shrink)

The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. Many people believe that philosophy makes no progress. Members of the general public often find it amazing that philosophers exist in universities at all, at least in research positions. Academics who are not philosophers often think of philosophy either as a scholarly or interpretative enterprise, or else as a sort of pre-scientific speculation. And many well-known philosophers argue that there is little genuine progress in philosophy. Daniel Stoljar argues that this is all a big mistake. When you think through (...) exactly what philosophical problems are, and what it takes to solve them, the pattern of success and failure in philosophy is similar to that in other fields. In philosophy, as elsewhere, there is a series of overlapping topics that determine what the subject is about. The paper aims to offer an account of the cognitive capacities involved in judgements about thought experiments, without appealing to the notions of analyticity or intuition. I suggest that we employ a competence in the application of the relevant concepts. In order to address the worry that this suggestion is not explanatory, I look at some theories of concepts discussed in psychology, and I use them to illustrate how such competence might be realized. This requires, crucially, distinguishing between concepts and (...) ways of applying concepts, or conceptions. In this paper, I motivate the view that quantitative parsimony is a theoretical virtue: that is, we should be concerned not only to minimize the number of kinds of entities postulated by our theories (i. e. maximize qualitative parsimony), but we should also minimize the number of entities postulated which fall under those kinds. In order to motivate this view, I consider two cases from the history of science: the postulation of the neutrino and the proposal of Avogadro's hypothesis. This book seeks to bring together the pragmatic theory of 'meaning as use' with the traditional semantic approach that considers meaning in terms of truth conditions. Daniel Gutzmann's new approach captures the entire meaning of complex expressions and overcomes the empirical gaps and conceptual problems associated with previous analyses.

Cryonics is the practice of cryopreserving the bodies or brains of legally dead individuals with the hope that these individuals will be reanimated in the future. A standard argument for cryonics says that cryonics is prudentially justified despite uncertainty about its success because at worst it will leave you no worse off than you otherwise would have been had you not chosen cryonics, and at best it will leave you much better off than you otherwise would have been. Thus, it (...) is a good, no-risk bet; in game-theoretic terms, cryonics is a weakly dominant strategy relative to refraining from utilizing cryonics. I object to this argument for two reasons. First, I argue that there is a practically relevant chance that cryonics will put you into an inescapable and very bad situation. Hence, cryonics is neither a no-risk bet nor a weakly dominant strategy. Second, I argue that the experience of being reanimated and living in the distant future would likely be transformative, and this likelihood undermines your justification for thinking that reanimation would be beneficial to you. I conclude that the standard argument does not show that cryonics is prudentially justified. (shrink)

The pessimistic hypothesis is the hypothesis that life is bad for us, in the sense that we are worse off for having come into existence. Suppose this hypothesis turns out to be correct — existence turns out to be more of a burden than a gift. A natural next thought is that we should stop having children. But I contend that this is a mistake; procreation would often be permissible even if the pessimistic hypothesis turned out to be correct. Roughly, (...) this is because we are often in a position to know that future people will approve of having been created, and their approval will not be inappropriate even if they are worse off for having been created. Plato's dialogues frequently criticize traditional Greek myth, yet Plato also integrates myth with his writing. Daniel S. Werner confronts this paradox through an in-depth analysis of the Phaedrus, Plato's most mythical dialogue. Werner argues that the myths of the Phaedrus serve several complex functions: they bring nonphilosophers into the philosophical life; they offer a starting point for philosophical inquiry; they unify the dialogue as a literary and dramatic whole; they draw attention to the limits of language and the limits (...) of knowledge; and they allow Plato to co-opt cultural authority as a way of defining and legitimating the practice of philosophy. Platonic myth, as a species of traditional tale, is thus both distinct from philosophical dialectic and similar to it. Ultimately, the most powerful effect of Platonic myth is the way in which it leads readers to participate in Plato's dialogues and to engage in a process of self-examination. (shrink)

Simon May has argued that the notion of a principled compromise is incoherent. Reasons to compromise are always in his view strategic: though we think that the position we defend is still the right one, we compromise on this view in order to avoid the undesirable consequences that might flow from not compromising. I argue against May that there are indeed often principled reasons to compromise, and that these reasons are in fact multiple. First, compromises evince respect for persons that (...) we have reason to think of as our epistemic peers, and acknowledgement of our own finitudes as moral reasoners. Second, compromises are often made morally necessary by the shortfalls that unavoidably separate democratic institutions from democratic ideals. Third, compromises express a desirable form of democratic community. And fourth, compromises are often justified from a consequentialist point of view, in that they allow for the realization of values that would not be realized as well by the failure to compromise. Sometimes, learning about the origins of a belief can make it irrational to continue to hold that belief—a phenomenon we call ‘genealogical defeat’. According to explanationist accounts, genealogical defeat occurs when one learns that there is no appropriate explanatory connection between one’s belief and the truth. Flatfooted versions of explanationism have been widely and rightly rejected on the grounds that they would disallow beliefs about the future and other inductively-formed beliefs. After motivating the need for some explanationist account, we raise (...) some problems for recent versions of explanationism. Learning from their failures, we then produce and defend a more resilient explanationism. (shrink)

The shooting bias hypothesis aims to explain the disproportionate number of minorities killed by police. We present the evidence mounting in support of the existence of shooting bias and then focus on two dissenting studies. We examine these studies in light of Biddle and Leuschner’s “inductive risk account of epistemically detrimental dissent” and conclude that, although they meet this account only partially, the studies are in fact epistemically and socially detrimental as they contribute to racism in society and to a (...) social atmosphere that is hostile to science as scholars working on issues of racism come under attack. We study the SIS and SIRI epidemic models discussing different approaches to compute the thresholds that determine the appearance of an epidemic disease. The stochastic SIS model is a well known mathematical model, studied in several contexts. Here, we present recursively derivations of the dynamic equations for all the moments and we derive the stationary states of the state variables using the moment closure method. We observe that the steady states give a good approximation of the quasi-stationary states of the (...) SIS model. We present the relation between the SIS stochastic model and the contact process introducing creation and annihilation operators. For the spatial stochastic epidemic reinfection model SIRI, where susceptibles S can become infected I, then recover and remain only partial immune against reinfection R, we present the phase transition lines using the mean field and the pair approximation for the moments. We use a scaling argument that allow us to determine analytically an explicit formula for the phase transition lines in pair approximation. (shrink)
